hey man it doesnt matter if the ipod had it if they have who says we cant have the same thing and make it better? what is so not right about it really?

You guys can always port it from Android since its free on that platform then leave all the trademarks and licenses in tacked. Just add an extra screen saying "ported by ___"

Except it's not open source...

It's perfectly possible to do a game with similar gameplay to Angry Birds, there's plenty of those out there already. Personally, I'd suggest stepping away from a "clone" of it and instead make a similar game but improve on it.

I could help put a story behind it.

i.e. just make the one in a thousand "cannon games." Other popular examples are Kitten Cannon and Crush the Castle.

i don't think "kitten cannon" is really the same genre, but there tons of them out there. i would be quite happy to see a game like this on the zune

Those were examples of two kinds of cannon games, distance and destruction, the latter being the kind Angry Birds is.
