Default Video Converting (Only Sometimes)

I use DVD-WMV to rip dvd's to WMV, and always use the same settings. When I sync them to zune it randomly decides to convert some of them. I cannot work out why this is. I thought it might be the bit-rate is too high at points because it's VBR but i don't think so... Any other ideas (I hate having to convert things then watch them convert again (and they're converting to a bigger file size with the same quality (GAH!)))

This does this for me with WinAVI, even following the instructions from here - zuneboards.com/forums/tutorials/10736-how-convert-your-movies-into-high-quality-zune-format.html

My settings are exactly as those described:

Encoder - (WMV Encoder), Broadband (NTSC, 700Kbps)
Picture Size - Width 320, Height 240
Video Frame Rate - Keep original frame rate
Audio Sample Rate - 44100
