You can have the same gameplay and it be legal. You just can't use anything that is from the game(Images, sounds, names, etc.)

hmmm ok, but not withstanding the request template specifically says no big franchise's (mario, sonic, etc.) so ....well well have to see. also it wold have to be a way low-gfx-no-huge-story-line,-run-around-and-kill-people type game
