earWith the latest news of some dude wanting to sue Microsoft for damage to his ears from his Zune,  I ask myself:  "are your friggin' kidding me?"  You may be too, so read to see if you feel me on this....

First off, how American is this guy?  Now I don't mean the patriotic- go-die-for-your-country self-sacrificing American - this dude is not that.  And I don't mean the living-the-dream-owning-a-home-a-wife-two-kids-and-a-dog American.

No I mean this guy represents to worst side of America, you know:  The welfare-dependant, selfish-in-everyway, let's-go-bomb-every-nation-we-hate, sensational-sue-happy America that the world has come to hate.

This guy represents the small population of Americans that are the reason the rest of the world hates us.  Why you say?

Sure the guy may have been hurt.  Microsoft may be liable in some way (but have you heard the term 'buyer beware'?).  He may have a legitimate case.  But who the hell puts up a website trying to make his case more lucrative sensational?

I should point out:  first, this guy calls MS about his problem, then he goes up into forums.zune.net and gets banned for complaining too much.  And now a website?  C'mon - If MS isn't resonding how you feel it should, have your lawyer call them - don't go putting up a silly website!

Yeah, this may get him more bang for his buck, and more people could sign on, but seriously?  A website?  Not to mention this may not get this Joel Geddis more money.  So what's this guys problem?

This is the first I've ever head of someting like this.  Has anyone had an issue like this?  I don't want to sound too insensative to this guy's issue.  He truly may have been hurt.  But by putting up a website, trying to imply the Zune is defectively produced, and trying to tarnish Zune's image is simply not cool in my book.

How 'bout you?  Have you ever had an issue with your Zune and bleeding ears (maybe you need to turn it down a skoash)?  If so, you can go to his website HERE to report a claim OR you can yell at him, but make sure not to yell too loud, 'cause you may make his ears leak a bit...(hey, he put up the website)

You know what?  I got hurt on my bike when I was like 10 years old.  Maybe I should put up a website to get everyone who got hurt on their bikes to go sue BMX...I've been literally scarred for life...

That's it, I'm getting off my soapbox now...

This guy can't win... there's a whole like two pages in the manual telling you not to listen to music loudly and how to know when you're hurting your ears, etc.

Probably a macTard who wants to see Microsoft finished. Too bad they can throw around...I dont know...44 billion dollars on the whim. If Microsoft does settle it will have established a dangerous precedent. They wont of course.

How ****ing retarded is this guy?
I agree with trustagustus.
And does this guy think he will win against Microsoft?

theres's a space in the image link on the zuneinjuries just take the space out in front of the zune part, anyways...

ive read this on a few websites and i just find it rather funny... even if he didnt mean to... you think he'd take the headphones out... and they'd have to be way louder than speakers at a concert, which, if he was using the default headphones, they would of blown way before they got that high of volume. i think something prior to this happend to him and he see's microsoft as a bag of money thinking they'd throw it at him to shut up...
shotgun_photo     | 69.159.71.xxx | 2008-02-03 12:06:07
sheeesh ... i would be more likely to be suing microsoft over the aggravation the zune software caused me than to own up to being stupid enough to turn up the volume on my mp3 player too loud.
secrethojo   | 68.8.16.xxx | 2008-02-03 12:29:01
WOW, i listen to my music loud and sure i have hearing loss, but its been a known fact for years, im not gonna go putting up a website for my own fault, this guy cant win in the court.
Anonymous   | 76.202.67.xxx | 2008-02-03 12:50:48
This guy isn't talking about the music being too loud on his Zune. He's talking about an electric shock going through to his earbuds, and then a random ultra high pitch noise when it started back up. Then blood started coming from his ears. I would sue if I was that dude, that is, if it's true. Personally, I don't understand why you would keep your earbuds in after they just shocked you. Moron.
jahazielsoto   | 76.167.57.xxx | 2008-02-03 13:09:18
this guy's *****ded seriously and i don't belive that earbud's could shock yuo to this point
jeff   | 67.183.82.xxx | 2008-02-03 13:33:55
the only time i had any problem is one time at work i was putting shrink wrap on some products and the static from the shrink wrap went from my body to the headphones and shocked me. it caused the radio to stop playing and i took the headphones out. maybe that is what happened to him.
adam   | 137.112.135.xxx | 2008-02-03 15:48:37
okay here is the deal, electronic devices accumulate a certain amount of electric charge (usually static if it is exterior) before they want to discharge it. thus, the first negatively charged surface the device comes into contact with will feel that shock. this guy could have just gotten a really good shock to the ear. hey, it happens, it doesnt mean you have to go and sue because of it
Anonymous - You misrepresented the claim..   | 69.110.136.xxx | 2008-02-03 16:29:05
Thank you "anonymous" for clarifying. I can offer further clarification...

The three events (shock, noise, and reboot) happen simultaneously. At the very same instant as the shock, the Zune blasts a noise through the earbuds (while overriding the user-set and default volume) and BEGINS the reboot sequence.

This problem is not rare and independent reports can be read elsewhere on the net - including Microsoft's own Zune forums.
Anonymous   | 76.235.221.xxx | 2008-02-03 17:16:14
Hah, I wrote a claim that the zune malfunctioned and now i hear things and see things and also i am a male that is preganant!
Anonymous   | 24.8.20.xxx | 2008-02-03 21:26:50
I"ve had that electocral shock in my ear before and its very uncomfoterable but it sucks for that guy
The Gangsta! - This kind of happened to me to   | 70.113.21.xxx | 2008-02-03 21:40:07
I was listening to my Zune with my brothers ipod headphones because I had lost mine and I touched my TV and the right ear bud shocked my ear. I was like WTF? I'm fine now but that was really freaky.
Bman22   | 76.113.4.xxx | 2008-02-03 23:19:45
I had the same problem, when getting into a car, but it didn't cause me to bleed from the ears and take multiple medications, including anti-depressants(WTF?. This isn't a zune problem, it's your fault. It means that wherever you where when it happened is very staticy. Might want to look for an antistatic device
trs21219 - wow...   | 96.235.31.xxx | 2008-02-04 02:40:13
i bet you if this guy was pumping gas and caused a static shock and lit himself on fire, he would sue fire for being caused by static electricity...

what a fucking dumbass. its not zunes fault your an idiot
Dude   | 76.9.69.xxx | 2008-02-04 06:30:33
But let me ask any of you guys...did you put up a website about it? That's ACE's point...
dsharp75 - So with you   | 198.173.15.xxx | 2008-02-04 08:02:51
I agree, greedy fcks like this ruin everything - because this dumb @$$ can't read or ignored the warnings, he wants to sue? Screw him - there's warnings on the headphones, warnings in the manual and I find it hard to believe a setting of 10 resulted in hearing loss. It just aint bloody likely. Now MS may pay a quiet amount to this prick to shut it up and avoid bad PR, NOT because this @sshole deserves it AND we'll get stuck with a crappy reduced volume Zune or subpar headphones. Only this prick wins. Stand up MS! We're with you!
Anonymous   | 134.88.186.xxx | 2008-02-04 11:01:59
screw microsoft man they have terrible customer service and i hope they settle for millions of dollars.
bob e   | 12.31.144.xxx | 2008-02-04 11:36:53
MS won't have to pay anything, that is why they have product liability insurance
J L - Wow   | 12.152.176.xxx | 2008-02-04 13:18:20
What happened to our sense of responsibility.
Federal   | 24.46.97.xxx | 2008-02-04 14:32:53
Wow what an asstard:

"My Zune reset...that means it's going to be loud like the last time. Maybe I should put my headphones in my ear anyway...oww"
alek   | 67.160.231.xxx | 2008-02-04 21:21:42
realy i almost made him deth and it wasnt his fault the zune went all crazy or ms (thats why u never pu mp3s in microwaves)
price   | 71.60.71.xxx | 2008-02-06 14:25:52
How wack are you for turning ZuneBoards into a GoDaddy.com by adding your political two cents to the blog here that is supposed to me about Zunes not your ideas.

What does any of this have to do with your opinions on welfare and the people unfortunate enough to have to use it?
SilverDragoon   | 71.197.87.xxx | 2008-02-12 01:07:44
when you open the box and pull the headphones out of the box what does the mini box for headphones say? "warning, loud music can damage your hearing." this guy better now win.
SilverDragoon   | 71.197.87.xxx | 2008-02-12 01:08:25
err i'm sorry not win i don't see an edit button on here
ricts   | 216.220.234.xxx | 2008-02-13 13:19:24
The only reason any company should have to pay any damages regarding their product is if they somehow failed in their normal operation, and that failure caused measurable harm in some way.

I am a but doubtful that the Zune itself created the static the created the shock. No doubt he was touching something that generated the staic charge, and the Zune was merely the conductor. Remember, there is a metal wire in the headphone cord, and it is connected to more conductive metal inside the Zune. If he were to touch anything that generates an electrical charge with the headphones in his ears, OF COURSE he is going to be shocked.

Just another case of people not taking responsibility for their actions. Remember the lady who sues Dunkin Donuts because she spilled it in her lap, and it burned her? Because her coffee was hot?

We're going to hell, folks.
Anonymous   | 71.227.98.xxx | 2008-02-15 11:01:05
I just got shocked by mine yesterday. It hurt really bad. The noise comes at the exact time as the shock. I was sitting at my desk at work when it happened.

No bleeding but ears were left ringing and still do in noisy situations. The volume was very low (6 out of 20).

I am on hold with Microsoft right now.
l3oss   | 76.245.122.xxx | 2008-02-23 16:42:48
